According to CDC spokeswoman Kathleen Conley, the U.S. Centers for Disease Control and Prevention is finalizing an assessment of the public health authority, known as Chapter 42, and is expected to announce a decision this week on whether to cancel, replace or extend the authority.
The Biden administration is under pressure from Democrats and immigrant lawyers to end its public health authority, which critics say has never been justified by science and harmed immigrants.
As many as 1.7 million migrants have been deported to Mexico or their home country since March 2020, according to U.S. Customs and Border Protection data.
Dealing with the US-Mexico border is a politically dangerous issue for President Joe Biden ahead of the midterm elections. Over the past year, Biden has struggled with the influx of unsupported immigrant children and the influx of immigrants into Del Rio, Texas, resulting in thousands of people being under a bridge.
If this order is revoked, it is expected to cause immediate harm. Homeland Security officials are preparing for the dire situation of up to 18,000 people trying to cross the border daily, a figure that will overwhelm the entire existing border facilities.
Three planning scenarios are devised to trigger what resources may be needed. The planning document states that the current arrest figures in the first scene are up to 12,000 people a day in the second scene and up to 18,000 people a day in the third scene.
“The nature and purpose of the relocation has changed fundamentally,” a DHS official told reporters on Tuesday.
The Department of Homeland Security has set up a “Southwest Border Coordination Center” to coordinate response to possible uprisings among federal agencies. Home Secretary Alejandro Meirkos in March appointed Marion Tyrney, regional administrator for FEMA Zone 3, as head of the center.

“This is what we do in the DHS. We plan for all kinds of contingencies, high probability or low probability,” said another Homeland Security official.
Tens of thousands of people on the US-Mexico border
An estimated 30,000 to 60,000 people are waiting to cross the South American border into northern Mexico, according to the Federal Law Enforcement Agency.
Intelligence estimates have found that people are on a “wait and see” and are trying to determine when they have the best chance of entering the United States, with 30,000 to 60,000 people able to enter in a matter of hours, the official said. The CDC rule was repealed.
The official said the White House had held more extensive reciprocal meetings about intelligence and the situation.
“It is important that (immigrants) realize that they have a greater chance of success,” the official said.
A few months before the end of this fiscal year, the number of people arrested at the border is expected to reach 1 million soon, U.S. Border Patrol chief Raul Ordiz said Tuesday. Those figures include repeat crossers.
Among the challenges for the authorities is the shift in population coming to the southern border of the United States. About 40% of the detainees are from countries other than Mexico and the northern triangular states of Guatemala, Honduras and El Salvador, a Homeland Security official said.
“I think it’s important that we deal with the increased flow now, and we’ll get as far ahead of this as we can,” Artis said.
